In order to implement the Law of the People's Republic of China on the Prevention and Control of Air Pollution and promote the implementation of the Emission Standard of Air Pollutants for Oil Storage Tanks (GB 20950-2020) and the Emission Standard of Air Pollutants for Oil Transport (GB 20951-2020), the Ministry of Ecology and Environment studied and drafted the Notice on Promoting the Treatment of Volatile Organic Compounds in Crude Oil Product Terminals and Tankers (Draft for Comments), which was issued on November 8, 2022, as follows:

In order to implement the Law of the People's Republic of China on the Prevention and Control of Air Pollution and promote the implementation of the Emission Standard of Air Pollutants for Oil Storage Tanks (GB 20950-2020) and the Emission Standard of Air Pollutants for Oil Transport (GB 20951-2020), the Ministry of Ecology and Environment studied and drafted the Notice on Promoting the Treatment of Volatile Organic Compounds in Crude Oil Product Terminals and Tankers (Draft for Comments), which was issued on November 8, 2022, as follows:

 

According to the document, the following six points are extracted:
1. To raise awareness, the crude oil and product oil terminals and oil tankers will be regarded as important areas of volatile organic compounds treatment at present. All localities should raise awareness, increase policy support, give full play to the role of fiscal and financial guidance, actively support the construction of oil and gas recovery facilities for terminals and oil tankers and the targeted utilization of recovered oil products as resources, and accelerate the governance of VOCs for crude oil, product oil terminals and oil tankers;
2. Reverse the construction period and promote the construction of oil and gas recovery facilities according to the standard requirements. For existing oil tankers with a gross tonnage of more than 8000 and new oil tankers with a gross tonnage of more than 150 engaged in oil loading operations in China, the construction or upgrading of oil and gas recovery facilities shall be carried out; If upgrading and reconstruction is required, the upgrading and reconstruction plan shall be formulated and completed by the end of March 2023;
3. Cooperate with ship and shore to strictly implement the operation and maintenance requirements of oil and gas recovery facilities. Relevant terminals and other enterprises should pay attention to the maintenance, operation and management of the oil and gas recovery facilities that have been built, implement the requirements for the management of pollution discharge permits, and formulate their own monitoring plans in accordance with the national self-monitoring specifications. The pollutant discharge units listed in the list of key pollutant discharge units should implement the requirements for the installation and networking of automatic monitoring facilities according to law, and put an end to malicious shutdown of idle oil and gas recovery facilities.
4. We will encourage pilot projects and actively support the resource oriented utilization of recycled oil products. The provincial (district, municipal) competent departments of ecological environment should actively support and promote the use of recycled oil products as alternative raw materials for petroleum refining, petrochemical and other industries under the premise of controllable environmental risks. For hazardous wastes, "point-to-point" targeted utilization exemption can be implemented according to the plan determined by the provincial ecological environment department. Recycled oil products in the utilization link are not managed as hazardous wastes, so as to reduce enterprise costs.
5. Compacting the main responsibilities of enterprises to ensure the safe operation of oil and gas recovery facilities. Relevant enterprises shall strictly perform the main responsibility of safe production, carry out the construction of oil and gas recovery facilities in accordance with laws, regulations and mandatory standards, and ensure that the conditions for safe use are met and the requirements for pollutant emission control are met.
6. Departments should cooperate to strengthen guidance, assistance, supervision and management. The local ecological environment departments, transportation departments and maritime administration agencies shall establish a joint supervision mechanism, comprehensively sort out and form a list of oil and gas treatment of oil tankers, loading dock berths and directly connected supporting tanks, establish a working account, and the provincial ecological environment department shall report the allocation and use of oil and gas facilities to the Ministry of Ecological Environment by the end of December 2023.
